♡ please read through my TOS carefully!! also please keep in mind i'm very new to doing comms so my TOS is subject to change. if you feel like i'm missing something or if my terms are unfair, please let me know! i'm willing to make exceptions to the rules here and there as well :3

ੈ✩‧₊˚ general + usage

-> general
♡ currently, i do not allow my work to be used for commercial purpose. TOS will be updated once this changes.
♡ i own all rights to my artwork. do not claim that you or someone else created my work.
♡ any characters appearing in my work belong to their respective owners.
♡ as an artist, i will give my best effort to provide you with friendly service and art of a quality that reflects the price you paid as well as my own abilities. i will try my best to get your request done in a timely manner, and let you know if something unexpected gets in the way!-> usage
♡ currently, my commission work cannot be used for commercial purposes (whether streaming/content or for merch/ads/prints)
♡ you may use commissioned work as a pfp/banner with credit to my twitter or instagram.
♡ you may repost commissioned work with credit to my twitter or instagram. please use the version with the larger commission watermark.
♡ i am allowed to post/share commissioned work and progress on my socials, as well as use in portfolios, art examples, art shares, etc. i will use the version with the larger commission watermark. if the client requests so, i will mention them in the post.
♡ if you commission lineart and want it to get colored by someone else, please contact me first or let me know beforehand.
♡ i am fine with color filters/doodles/frames/etc. being overlayed on top of my work (e.g., drawing cat ears and whiskers on a character's face), but if it is posted anywhere make sure to clearly state what you added. do not overlay anything offensive or problematic, and do not directly edit my work (changing the lineart and coloring, changing proportions, editing drawing to change gestures, expression, etc).
♡ i will not use commissioned work for prints or other merchandise unless allowed for by the client.
♡ i do not consent to my work being used for AI machine training or to being put into an AI engine.

ੈ✩‧₊˚ payment and pricing + revisions

♡ i only take commissions through vgen.
♡ base pricing follows pricing charts.
♡ additional characters/drawings of a character are fully priced according to the pricing chart.
♡ simple background/props are an additional 10-15% of lowest base price.
♡ complex designs are an additional 15-20% of character base price.
♡ after i give you a final quote on the commission price, 50% will be paid upfront. the other 50% will be paid when i finish the commission.
♡ any revision fees will be added onto the second payment.-> revisions
♡ *for lined/rendered illustrations* during the sketching process, i will allow 3 major revisions. once i get confirmation and begin lineart, i will only allow 5 minor adjustments. once the commission is completed, i will only allow the following changes (+ the 5 minor adjustments, if you have not used them already): adjustment of lighting/shading strength, color filters/overlay, lineart coloring.
♡ *for sketched illustrations* during the sketching process, i will allow for 3 major revisions and 3 minor adjustments. any more than that will incur an additional fee (see below).
♡ *for skeb/surprise me* i do not offer revisions. i will correct mistakes.
♡ it is my discretion what constitutes a major revision or a small adjustment.
♡ further revisions or adjustments that begin to interfere with the commission process will incur an additional fee of 10% of the price quote given before the commission is started. each of these revision/adjustments is charged separately and will be added onto the second payment.
♡ i will not charge for rectifying mistakes made during/after the commission.

ੈ✩‧₊˚ deadlines and delivery + refunds and cancellation

♡ when we first discuss the commission, i'll give you a rough estimate of when the work will be finished.
♡ i am still starting with commissions, so deadlines are going to very loose and over-estimated.
♡ i do not do rush jobs. if you find yourself needing a commissioned piece sooner than expected, there is no guarantee i'll be able to finish it within that time period, and i recommend that you cancel the commission.
♡ when the commission is finished and paid for, i will send two png files: one with a smaller watermark, and the other with a larger commission watermark. the latter should be what you use for social media reposts, but the smaller watermark is for personal use.-> refunds and cancellation
♡ VGen automatically will refund work that has not been completed past the due date.
♡ i am allowed to cancel a commission for any reason at any point in the commission (cannot complete, client-customer interactions, real-life obligations).
♡ likewise, clients are also able to cancel a commission for any reason at any point.
♡ if the commission is cancelled, i will calculate the cost of the work finished so far based off the pricing chart. if the 50% upfront payment was more than this cost, i will deduct the cost from the payment and refund the difference. likewise, if the 50% upfront payment was less, then i will charge the remaining amount to the client.
♡ e.g., 50% upfront payment was $20 and i finished only $10 worth of work, i will refund you $10.
♡ e.g., 50% upfront payment was $20 and i finished $30 worth of work, i will charge you $10.after the refund/charge, i will send the two png files.
♡ finished or almost completed (e.g., i'm adding a few tiny details or flourishes and then i'm done) works do not qualify for a refund.

ੈ✩‧₊˚ process + communication

♡ please send full/clear references and examples when requesting your commission, and be clear and descriptive as to what you want. i will message you if i am unclear on something. likewise, if you have further questions, please feel free to message me.
♡ after accepting the request and sending the proposal, i will begin messaging you about the commission and sending progress on the sketch for adjustments and confirmation. once you give the final confirmation on the sketch, i will begin lineart.
♡ if your commissioned work is shaded or fully rendered, i will reconfirm that the shading in the sketch is accurate before beginning.
♡ once i finish, i will send a low quality, watermarked version to confirm that you are satisfied with the final result.
♡ once the second payment is made, i will send the finished pngs.
♡ throughout the commission process, any progress images i send may be watermarked, at a lower image quality, and/or cropped as to not show the full image.-> communication
♡ i live in the US, and am in the CDT timezone. i am usually active from 8pm-2am.
♡ do not hesitate to message me at ungodly hours!! i'll just respond when i am able to get back on.
♡ let me know how often you'd like updates on your commission (e.g., as i work, daily, every other day, weekly, only when you request an update, etc.) and if this preference changes.
♡ my main methods of communication will be discord and vgen. you can reach out to me on twitter or instagram if you really want, but keep in mind i do not check those often, and i much prefer discord or vgen.
♡ if i do not respond for a day or two, it's likely because of work (save me from my retail nightmare guys) or other real-life events. i will let you know ahead of time if i will be difficult to contact for 3+ days.
♡ keep conversation civil, simple, and polite. aggressive or hostile behavior will result in me rejecting or cancelling your commission.
♡ i will not send updates for skeb/surprise me commissions.
♡ try to keep conversations related to the commission (some small talk is fine but i don't want an itinerary of how your day went... and i'm sure you don't want one of mine either). this goes both ways! i'll be nice to you, you'll be nice to me. everyone's happy.
